This service ("the Service") is provided to you by Valuescope GmbH, whose registered address is Zielstattstrasse 42, 81379 Munich, Germany, ("Valuescope"), subject to these terms and conditions. By using the Service or any information or other material contained within the Service ("Information") you agree to these terms and conditions.

30-DAY FREE TRIAL

We will make our service Finsights available to You on a trial basis free of charge until the earlier of (a) the thirtieth day after Your acceptance of this Agreement or (b) the start date of any Purchased Services ordered by You. Additional trial terms and conditions may appear on the trial registration web page. Any such additional terms and conditions are incorporated into this Agreement by reference and are legally binding.

ANY DATA YOU ENTER INTO THE SERVICES, AND ANY CUSTOMIZATIONS MADE TO THE SERVICES BY OR FOR YOU, DURING YOUR 30-DAY FREE TRIAL WILL BE PERMANENTLY LOST UNLESS YOU PURCHASE A SUBSCRIPTION TO THE SAME SERVICES AS THOSE COVERED BY THE TRIAL OR PURCHASE UPGRADED SERVICES BEFORE THE END OF THE 30-DAY TRIAL PERIOD.

DURING THE 30-DAY FREE TRIAL THE SERVICES ARE PROVIDED “AS-IS” WITHOUT ANY WARRANTY.

Please review the User Guide during the trial period so that You become familiar with the features and functions of the Services before You make Your purchase.

We try to ensure but can not guarantee or accept liability for continuous availability of the Website or that it will be without interruptions or that transmissions will be error-free. However, we cannot, due to the nature of the internet, guarantee that your access will not be suspended or restricted from time to time due to maintenance, or the introduction of new facilities or services. We of course try to limit the frequency and duration of any suspension or restriction.

Intellectual Property

The term "Intellectual Property Rights" means, copyrights, database rights, trade marks, trade names, domain names, rights in logos, get-up and content, inventions, trade secrets and know-how, patents, all rights of whatever nature in computer software and data, all rights of privacy and all intangible rights and privileges of a nature similar to any of the above, in every case in any part of the world and whether or not registered; and including all granted or pending registrations, and all rights to make applications for registration in respect of any of the same.

You may not use or reproduce any Valuescope Intellectual Property, including any trademarks, registered or unregistered, (such as the "FinSights" name and logo or other trade names appearing on the Sites) for any reason without written permission from Valuescope GmbH.

The software, which operates the Sites, is proprietary software and you may not use it except as expressly allowed under these Terms. You may not copy, reverse engineer, modify or otherwise deal with the software.

The methods of searching and presentation of Information, certain information content, graphics, layout, design and other features of the Service are also protected by intellectual property rights belonging to Valuescope GmbH. No licence is granted to you in respect of any such rights, except to the extent required for your personal use of the Service in accordance with these terms and conditions.

NO WARRANTIES

The following clauses exclude or limit our legal liability in relation to this Website. You should therefore read them carefully. They apply only as far as the law permits.

Whilst we endeavour to ensure this Website is normally available 24 hours a day, we shall not be liable if for any reason this Website is unavailable at any time or for any period.

Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

We do not represent or warrant that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. Valuescope GmbH may, at its discretion, change these Terms (including those relating to your use of the Sites and/or the Valuescope Content). When the Terms are changed, Valuescope GmbH will notify you by email or by publishing details of those changes by including them in these Terms.

Invalid Provision
If any provision of this agreement is held to be invalid by a court of competent jurisdiction, Valuescope GmbH shall amend the invalid provision in such reasonable manner as achieves the intention of the parties without illegality, or at Valuescope’s discretion such provision may be severed from this agreement and the remaining provisions shall nevertheless remain in full force and effect. Any cause of action of yours with respect to these Terms must be filed in a court of competent jurisdiction in Germany.
